    Exclamation Can My Previous Employer Change His Reasons for Firing Me to Unemployment

    My question involves unemployment benefits for the state of: indiana

    I worked at a theatre for 5 months. The owners (first time theatre owners) were friends of mine, and at first, everything was going fine. This was my first management position, and I went in thinking I would be given guidelines and training to help me understand what the job was all about. Contrary to my belief, none of this happened. I was thrown into it and was expected to figure things out on my own. While frustrated, I thought i was doing a pretty good job, given that one of the employees that had been there for 3 years said that sales had never been so good, and that things ran so much smoother after i took over. one day out of the blue, i get a text message saying that they were making an administrative change, my check would be in the mail (which was not, i had to pick it up myself) i was to hand in my keys and not enter the theatre. I never received a real reason, even after asking for written documentation. i suppose since we were friends i expected something more than 'administrative change.' so i filed for unemployment. i got it for like the first two weeks, then it stopped coming. i then received a call from workforce one asking why i was let go, and as i said before, i had no information to give them. My employer,however, gave a bunch of bogus reasons. There was a door left open once, no one could figure out how it happened. i've since decided it didnt get latched by whoever, and it blew open. My employer had the state and county police come in with drug dogs to make sure i wasnt dealing out the back of the theatre. if that wasnt enough, they said there were possible criminal charges against me because they were having the books audited to see if i was stealing money. then they said i was never available, which was also untrue. and to top it off the place was never clean supposedly. there were also supposedly numerous verbal warnings, but none of them are in my employee file with my signature stating that they happened. all these were given to unemployemtent as reasons, but were never given to me officially. they even went as far as to tell them that i called the fire marshal on them about a fire code violation after i was fired, even though it was an anonomous tip. i have no idea who called them, but to tell them it was me is just disturbing here on my end. to finish this up, i got my back pay because they deemed my dismissal unjust. they are now appealing. i am very nervous about this because paying back all that money will be nigh impossible for me if the judge doesn't grant in my favor. is my employer allowed to change reasons like that on me? i know i was a good employee and this is disturbing. sorry if i rambled, im just really nervous about all this

    im sorry, i may have worded it wrong, my paperwork says that the conclusion of the case was "the claiment was not discharged for just cause. IC-22-5-15 (d) states a discharge for breach of duty reasonably owed an employer by an employee is disqualifying. it cannot be established that the claimant's actions meet this definition. no disqualification.

    So you applied for unemployment, your former employer objected, you and the employer participated in a hearing after which you were found to qualify for benefits, and now your employer is appealing?

    im sorry that this is so confusing. i applied, received benefits, then it was delayed for 3 weeks because of the differences between what i said to unemployment, and what he said. the first time i talked to someone from unemployment it was just me talking. my employer had been spoken to seperately, where he gave the bogus reasons why i shouldnt receive benefits. after the results of the 'interviews' came back saying i was NOT disqualified, he appealed the decision and we have a hearing in a few days. my main concern is of course what he is going to say in the hearing, because what he told them the first time was major bs. if i can prove that the reason i was given for my dismissal was ONLY 'administrative change', what affect does his 'new' reasons have on the case? if he has no documentation on it, are his reasons valid? and whatever documentation he gives the judge, he is supposed to send to me before the hearing right?

    Your answer is that you did the job to the best of your ability and the issues they are raising never happened or you were never consulted about their concerns.
