    Default Statute of Limitations for Car Accidents in Washington

    My question involves a traffic accident in the State of: Washington, City of Burien, County of King.

    I was rear-ended by a FedEx tractor trailer back in May 2010. I was in the process of filing a claim with Sedgwick CMS (FedEx insurance co).
    Unfortuanately I got very busy and then went overseas for a few months. During that time I had no contact with Sedgwick CMS.

    They sent me a letter in October 2010 requesting for documentation of damages to my vehicle. Then in February 2011 they sent me a letter that said...
    "If we do not hear from you or receive the requested documentation by March 09, 2011, we will assume that you do not wish to pursue this claim and will close out file accordingly."

    I didn't receive their letters until I got back home in April. Does this mean that I can no longer make a claim with them? Is there a statute of limitations for personal injury and property damge for automobile accidents?

    I went to my doctor once and was prescribed muscle relaxers. My vehicle just had a few scratch marks on the rear bumper cover, and bumper reinforcement shifted a little.

    Thanks for any advice.

    You have 3 years to sue (if necessary) for both property damages and personal injury. What they do internally with their files is irrelevant. They want to close out their files and are simply attempting to do so. It does not affect your right to make a claim.
