My question involves landlord-tenant law in the State of: New York City
My Lawyer in NYC says that I can't demand the late fee (for paying rent late) from the tenant if I bring him to court to try to evict him for ALWAYS paying rent late. This tenant always pays rent late but in the past, he always agreed to give me a late fee for paying the rent (consistently months late). Now I decided to take him to court and the lawyer drew out a stipulation for him that requires him not to pay the late fee (just the rent in its entirety). I later realized this and questioned her and she said that it is illegal in nyc to ask for late fee if i am bringing him to court?
So is it or is the lawyer trying to cover up her mistake?
