    Default Following to Closely Caused by a Police Officer

    My question involves a traffic ticket from the state of: DE

    Tonight on the way home from work I was headed down a major interstate, and during the process of going through an EZ-pass I was pulled over for following to closely. What happen is this, i was traveling in the far left hand lane well behind the police car going the speed limit or under, the lane to my right was merging. I decided to speed up (at most 3 miles an hour from current speed) to allow the vehicle to my right to safely merge behind me. While doing this the police officer in front of me slowed his vehicle about 15 miles an hour under the speed limit, before i had time to react to the slowed up police car because of the lanes merging I approached the police officers vehicle, the police officer slowing up caused me to approach him and I could not hit my breaks because there was a car immediately behind me and I could not switch lanes because that lane had just merged.

    There was 0 reason for the police officer to reduce speed, there was no vehicles in front of behind him, and the lane he was in merged into a wide open road. He decreased his vehicle speed by 15 miles an hour because when I finally approach the officer he was doing 15 under the speed limit, he slowed up enough to allow the vehicle to his right to pass him, then he pulled me over. As simple as I could put it the cop was well in front of me before he reduced his speed and put me between two cars with no exit.

    To me this is entrapment, but i wanted to get your thoughts.

    I think you need to leave more room between your vehicle and a police vehicle in the future. You are responsible for managing the space in front of your vehicle. This includes leaving room for an indecisive driver.

    so, because there was a car following you too closely, you could not adjust your distance to the cops car?

    I would have to say that you needed to adjust your distance to the cop and let the guy following you too closely worry about what it takes for him to avoid hitting you.

    U,mm so somehow it's okay for the cop to deliberately cause a situation that puts me in danger. I do not feel like being hit at 65 miles an hour

    I'm sure his dash cam will show the decrease in his speed and the situation he put all the drivers in

    How do you know he was not responding to something he saw coming up? It is your job to allow assured clear distance, for the vehicle in front of you. You failed to do this. You should have been prepared and slowed to match his speed safely.

    You would have to ask him his justification for slowing but I suspect it might have been to allow you to pass so he could pull you over for speeding when you sped up to get in front of the car that was merging.


    Other than that, his actions do not excuse your actions.


    and chances are his dash cam, if he has one, was not operating until he turned on his lights to stop you. Car cams are usually not active until they go to lights and/or siren.

    I understand your points but if he's claiming I speed up then he would have to know what I was going and if he can't prove that then I can easily provie my speed never changed and he was the cause of the situations. How do I prove if he was on duty at the time?

    And I did ask him about his reasoning for slowing up and I told him I never went past you because you were going faster than me and then he pulled me over and he kept saying so what does that have to do with you and the merging lane. So that proves he was ahead of me going faster and he acknowledged that. He always forced the ticket to be a mandatory court appearance so he's going to earn that ticket. The price and points are the same so the court is going to earn this one. I'll request the tape of his patrol car to be present

    if he was driving the speed limit and you were closing the distance between you and him it is obvious you were speeding. Since you didn't get ticketed for speeding you can't do anything about the issue if you disagree though but in most states, that is adequate to issue a ticket: speeding. A ticket does not always have to say how fast you were going.

    to find out if he was on duty, contact his duty station and ask.

    Thanks Jk i understand what your saying but this isn't a speeding ticket or a reckless driving ticket this is a following to closely ticket. And my point is he caused the incident of following to closely I could not pull over I could not stop I could not switch lanes and he slowed his car to force me behind him
