My question involves criminal law for the state of: CA
Got my first DUI on 10/2009, BAC was .11, completed everything that was required and currently on DUI Probation. I was pulled over for speeding, CHP clocked me at 87mph, conducted field sobriety test, submitted to breath test, and BAC was .025. CHP issued me an infraction ticket for violating DUI probation, didn't give me a speeding ticket, gave me the DMV temporary license form, gave me back my license, didn't impound my car, and let me go if someone picked me up.
I've researched online to see what kind of consequence I should expect, do I need to get an attorney?
I contacted the CHP to get a copy of the ticket report, my DMV hearing is next month, followed by my court date the month after. I received a letter from DMV saying my license will be suspended for a year unless I request a hearing which I did already.
I know I screwed up and got real lucky; so I think. I'm looking for any insight from legal experts and/or people that has had similar situations.
