    Default Working with CPS After Being Falsely Accused

    My question involves child abuse or neglect in the State of: Louisiana
    My 6yo went to school sick on Sept 30th. He didn't tell me he was sick. He told the school nurse his neck hurt. He actually meant his throat. Well he ended up getting confused and said my step dad 'choked' me. My son said they asked him if he had been choked. The night before they had been rough housing and wrestling like they do every night. He got home from school and he had a 103 fever and I asked why didn't he ask to come home if he was sick and he told me what happened at school. I took him to the Dr found out he had strep throat. The following Mon we get a visit from cps worker asking us questions as to why my husband choked my son. We told her what happened and she interviewed my son since he was still home sick and he told her the same thing that he told me on Fri that they were playing. The cps worker asked to talk to my other kids and I gave permission. I have nothing to hide. She also suggested that my husband stay elsewhere until the case was resolved. We did what was asked of us and we didn't hear anything until last Monday that they were turning the case over to family services and we would have to go through some classes and therapy before my husband would be allowed home. We are doing what is asked of us cause the kids do come first. If we follow through with their plan and they close the case can they prevent my husband from coming home for good? My kids are confused cause they only know my husband as daddy cause their daddy died when they were very young. Please help. Idk how to deal with cps and we cant afford a lawyer. Me and my kids just want their daddy home.

    I would have refused to leave, had I been your husband. Their reaction would tell me what your standing is. Since you have bent over to follow their lead, you are stuck playing the game as is, IMO.

    If you do what they ask we have no reason to believe they won't do what they have indicated that they are going to do - but you want to avoid conflicts with CPS workers right now, because they can magnify little things into reasons to impose additional requirements or to take additional actions.

    I think it would be sensible for you to consult a lawyer, not to confront CPS right now but to advise you about your situation and to form a strategy in case you have additional problems.
