    Default Trial by Declaration - No Status Change After a Month

    My question involves traffic court in the State of: California


    I was given a ticket at 1:00 am for not using a left turn signal (which I did) to turn into my street after beeing chased by an officer on a huge SUV for no reason and then proceeded to stop me when I was already 65 feet inside my property. I decided to fight it.

    As it often happens, I forgot about filing until the last day. On that day (09/07) I went online and filed for an extension as it gave me that option. The extension was granted until November, but I filed the paperwork in person on the 9th, just a few days later. I paid my bail and I was given the TBD form and a date to file by the clerk. I filed the TBD a few days before the deadline, also in person at the courthouse. Everything seemed in order and I got my recipts.

    It has been a month now and my online status shows no sign of the TBD and no change since. I have no idea of what is happening and I was hoping someone with some knowledge could help me decypher:

    Violation Date: 07/06/2011
    Initial Due Date: 09/07/2011
    Case Status: Extension
    Disposition: 09/09/2011
    Last Action: Extension
    Last Action/ New Appearance Date: 11/07/2011

    Relax. TBDs at LASC tend to lag. Give it another 2-3 weeks. The status should update with your TBD decision date (it will say "appearance" so DO NOT freak out over that). Mailing the decision out to you after that date may take another few weeks. Keep receipts of everything and you're good.

    Where did you get that it was LASC, Quirky?

    Either way, I second the "relax" motion. Considering the fact that no one here can definitively decipher the online status, do make an effort to contact the court for clarification, and just because you have a receipt that it was submitted, does not necessarily mean it was filed properly (if it is indeed LASC, we have seen some creative interpretations in how matters are filed in those courts).

    BTW, ^that^ happens to be my favorite sentence in your entire post. Did you really think the officer was going to punch his steering wheel and grunt a "damn, another one got away" simply because you were 65 feet inside your property line?

    Hopefully, your defense argument is not based on that fact alone.

    I was returning home at 1:00 am from the supermarket and out of nowhere I heard this loud engine sound, looked in the backview mirror and suddenly saw a large black SUV had jumped a red light, raced 40 feet and begun aggresively following me at less than a car's distance, headlights blasting. I drove for three and a half blocks scared out of my mind thinking "I am about to get shot or beat up or god knows what." On the last left to my house I made a super fast turn (using the blinker, blinked once...so you get how fast) hoping to get away from whoever this person was....Having no safe public place to go to at that time, I pulled into my house praying I would make it to my door and hoping whoever it was they had no gun....and I was about 65 feet inside my property when the officer turned on his lights, which is the first time I even knew who this person was. This was not a case of standard pacing nor an standard police cruiser; This officer proceeded to chase a civilian at 1:00 am with a 1/2 ton SUV in the most aggressive of manners for absolutely no reason (no speeding, no rackless driving, no questions of alcohol or drugs or guns....nothing.) all the way to their home and then when NOTHING came up, he suddenly claims this BS fine about a blinker. I had no tickets, all paperwork in order, no warrants or pending issues and I was in my residence...no reasons to run away from a cop....unless....I did not know the mad man behind me was a 28 year old sargent moron playing rope-a-dope with people's lives on a slow Sunday night.

    I made my arguments, with maps, photos and a neighbor's affidavit: I won a no seat-belt ticket already. I am gonna win this one as well.
