Her viola instructor. He is fairly well-off. Not rich my any means, but he can afford $10,000 violas, a house, and to take care of his retired mother.

    Oh really?

Is he even vaguely aware of the consequences of this?

He is making a promise to the US government that the sponsored immigrant will not become a public charge. Food stamps are a means-tested benefit which would fall under that category.

In other words, the US government can (and generally will) come after him for reimbursement. (And you, actually, if you're a co-sponsor).

I would strongly recommend he not go ahead with this.

That is great, thank you. I was mostly worried about my eligibility for the Pell Grant. Anything that would get her instructor in legal trouble we just wouldn't do because he is like a part of her family. I have no clue if he knows of any repercussions, but I do know that he is perfectly fine to trust my wife.

What assistance programs are not considered means tested public benefit programs?

The following types of assistance are not considered means tested public benefits and do not have to be repaid.

    Emergency Medicaid
    School lunches
Immunizations and treatment for communicable diseases
Student assistance to attend colleges and institutions of higher learning
Some kinds of foster care or adoption assistance
    Job training programs
    Head start
    Short-term, non-cash emergency relief

Get a job; sponsor her; go back to school when you can afford to do so. How is she affording school since she is illegal and not qualified for most assistance? I hope she has not committed identity theft and used a false or stolen social security number.I hope she never represented herself to be a US citizen since this has serious repercussions.

    That's an absolutely excellent question.

Default Re: Adjustment of Status if Citizen Spouse Has No Income

She is taking two classes at a community college because it is so expensive, and her parents are paying with money from relatives and savings. None of her close relatives are citizens... could they be sponsors anyway?
