    Default Signing Contract for New Job, Leaving Before the Job Starts

    Hello everyone,

    I have been offered a one year work placement in a particular company. They have since sent me a whole load of documents, including some that need to be signed. However I am still looking at other companies for work placements. The deadline I have been given to sign these documents is only a few days away and because of this I believe I have no option other than to sign them. The job does not start until sometime in August, and the only clause I can see to do with notice period is that you must give 4 weeks notice from the commencement of the placement.

    So what about leaving the job before the actual start date? Where do I stand legally bearing in mind there are no clauses that talk about before the commencement?

    Since we cannot read the documents from here, I would suggest that you have them reviewed by an attorney in your state.

    Thanks for your response. I understand that that would be the best option. However it is awfully expensive and I was hoping for a bit of free advice on the matter.

    Penny wise but pound foolish!

    Due to your circumstances, you may need to sign the employment documents now in order to assure employment in August. You want to assure that if a better job offer comes along that you can leave your employer without repercussions.

    Without expending the hundreds of dollars it may cost to have an attorney expend an hour or two reviewing said documents and offering you an informed opinion, you run the potential risk of tens of thousands of dollars of legal expenses and headaches down the road if, for example, your employer can rely upon these seemingly innocuous documents to preclude you from working for another company.

    Your situation does not call for a DIY project! If you want assurance concerning your options, you will have to engage a local attorney to survey the landscape on your behalf.
