    Default Favoritism and Discrimination

    I am doing more research and would like to get opions of those of you who think Favortism and Discrimination are closely related (workplace)? Thank you!

    You mean, do bosses and supervisors tend to favor employees they like and disfavor those they dislike? Often that is the case. But that of itself won't support a cause of action.

    Favoritism is a form of discrimination. Discrimination means different treatment because of some factor. Most discrimination doesn't violate employment laws.

    Favoritism is different treatment because the person is liked by the person in authority or the employer.

    Illegal discrimination occurs when the person is treated adversely because of factors protected by law. The EEO laws prohibit adverse treatment because of race, sex, religion, national origin, color, age and disability.

    Examples:

    The supervisor promoted Mary instead of Ann because Mary and the supervisor play bridge together. That's favoritism.

    The supervisor promoted Mary because she was better qualified for the job than Ann. That's discrimination, but an acceptable form.

    The supervisor promoted Mary instead of Ann because Mary is white and the supervisor believes that white employees make better supervisors. That's illegal discrimination because the promotion decision was based on an impermissible factor, namely race.
