My question involves criminal law for the state of: ARIZONA
So last night I was outside and Campus PD just happens to walk around the corner in search of a "reported assault" but instead smell marijuana coming from my direction. They searched me and found a pipe. The officer begins to take down some information from the drivers license on a notepad and we head towards his police car for my citation or for him to take me to jail. All of a sudden, he gets this call saying that he is needed for back up and throws me my drivers license and says he will send me a summons in the mail. He then runs down to the parking garage and I go back inside.
Well, about 5 minutes later he comes back and knocks on my door, I meet with him and go to the lobby of my building to talk and he wrote me a citation for drug paraphernalia. The county that I reside in allows for drug offenses to be charged as a misdemeanor, so thats what mine was cited as since I was being compliant. He then lets me go back to my room with my ticket. I have one violation A.R.S. 13-3415 A
This is not my first offense, when I was a minor I was arrested for possession of marijuana but completed deferred prosecution in order to get it expunged. But a few months ago, I was caught and cited by police for being drunk on campus (MIC) which is also a misdemeanor.
Is it likely that I am facing two misdemeanor convictions ahead of me now? I understand that Prop 200 is keeping me from jail since I have never been convicted for drugs or anything before. Besides contacting a lawyer, which I surely plan to do, what can I do? what can I expect and what's the likely outcome for this type of situation?
