    Default Shoplifting Auto Parts

My question involves criminal law for the state of: Michigan.

Ok so my 21 year old little brother was caught shoplifting a pair of $10 headlight bulbs(which is $20 together) last week at a Walmart. He's sorry that he's done it and won't ever do it again, but he said he did it one time a week before the incident. He didn't say what it was, but he didn't get caught. The security didn't call the police, but they did say he would have to pay a fine that would be in the mail in a couple of weeks for the headlights. He has a clean record, is a college student and hasn't done anything like this before. I'm worried(even though i'm sure he's more worried than i am) that he's gonna get a criminal charge for this. So i want to know is it possible that he will get a criminal charge for this, even though he said that they wouldn't do it? And also, how likely is it that they would look at previous old security footage, and how long do they usually keep their security footage? Please give me any good advice since i'm trying to help him because he's so scarred right now.

yes and if he refuses to pay the civil demand he will be notified of in the mail, the chances of them actually filing this as a criminal complaint increase dramatically.

Only they know if they would bother with it or not. If he admitted to them the date, they may go looking at the video. Without some way to narrow down the time of the first theft, I suspect it is unlikely they would go watching old video trying to find him on them. You have to realize they have a lot of cameras in any given store and somebody would have to sit and watch the video from each camera until they found one that shows your brother. Then they would have to look for his criminal acts.

As to how long they keep video records; no idea.

You mean that he will admit to correct? He only admits to the ones they might have him on this time. If they find the footage of the last incident, they will likely take him to court as a multiple offender. They will likely post a still of him, for other LP to view. If one remembers him from last week, he will likely be charged in court.
