    Default Staying on a B Visa With Pending I-360, After Expiration of R1 Status

    Thank you in advance for your help with this.

    I applied and received receipt for i-360 about a month ago. My current status (R1) will expire in about six weeks and I cannot extend it (been on it for 5 years). I highly doubt I will get approved before six weeks is up.

    Can I apply for change of status to B2 so that I can stay in the US (hopefully for six months) as a visitor?

    I noticed that in the application there are questions such as "are you in the process of applying for permanent residence" and there is the question of intent. I do not wish to jeopardize any future possibility of applying for permanent residence were the possibility to arise.

    A B2 visa is a nonimmigrant visa, and requires that you declare that you do not have intent to immigrate.
