My question involves a marriage in the state of:California
Im asking in regards for my father. We moved to Arizona after his divorce. He was making $10k per month and was ordered to pay $1500 per month. In june of 2007 he was terminated from employment. On august 10th of 2007 he was hospitalized for liver failure and put on disability at that time. He is unable to work and is awaiting a liver transplant via Mayo clinic. He has also become diabetic as a result of the liver failure. She voluntarily reduced spousal support to $900 per month in march of 2010. He currently gets $2243 per month on SSDI. This results in 40% of his SSDI for spousal support and the remainder for cost of living. This requires using savings to supplement SSDI due to lack of income.
Now for some information on the spouse. She has been co habitating since october of 2003 with my fathers best friend at the time. She has not sought education or training to become self supportive since February 2005 when she started receiving spousal support. She is healthy and suffers no disability.
Is my father in a position to have spousal support reduced to 20% and or terminated since his only income is SSDI? The original Divorce decree was set at spousal for life or until retirement at 65 due to long term marriage. (Doesnt sound fair to me)
What are his options at this point? I dont want to push him to get a Lawyer until we have better understanding as to his position. Thanks for any help in this matter. Look forward to your response. Respectfully Jason
