    Default Claiming a Child As a Dependent

    I live in Virginia. My child was born December 28,2010. I claimed her as a dependent for my 2010 taxes. My child and I lived with her father for 6 and 1/2 months. I received $6,200.00 for my tax return which I used to help support our daughter and I received $4,000 in that time as income which also went to helping support her. We spent half of July seperated and my daughter and I actually moved out on August 2 so for the other 5 and 1/2 months I'll have provided 100% of her support. I feel as though I'll have provided over half of her support for this year. I am the custodial parent and we have a pending child support case. Aren't I entitled to claim her?

    During the 6.5 months, who provided the majority of financial support? Were you working?

    I was employed but on paid maternity leave for 3 and 1/2 of those months. The other 3 months I cleaned houses.

    Also, since you left, how many overnights has Dad had?

    I'm sorry, during the 6.5 months we provided an equal amount of support. Dad has had no overnight visists. He comes over to my house 3-4 times a week, 30 minutes at a time.

    Are you saying that during that period - and hon, there is a reason why I'm asking - $10k was what you each contributed?

    You supplied $10200 to the household over that period, for a household of 3. How much did dad provide to the household in wages?

    How much income will you declare on your taxes for the rest of the year after you left (we will call this X)? I would take $10,200/3 + X/2= you provided to child. Dads income while you were together, we will call Y. Income/support dad provided to child we will call Z. Y/3 + Z = dad provided support.

    Even if dads amount is higher, you still must provide him with IRS form 8332, for him to claim the child. I always suggest parents work together, when an 8332 situation develops, absent a court order. The formula I give to the custodial parent(you), is dads refund, claiming child - dads refund not claiming child= dads benefit for mom signing 8332 form. Negotiate a percentage of this, bearing in mind any child support paid by dad.
