    Default Can Your Landlord Refuse to Accept Rent if You Owe Past Rent or Fees

    My question involves an eviction in the state of: Ohio

    I live in an apartment and have been here for a year now. And I have been late on a few payments, 2, in the past. I happen to be late again, with my rent this month. I came home today to find a notice on my door that states that I have to pay all my late fees and my rent for this month by Friday, or they will refuse just my rent payment and file an eviction. Is this legal? I mean can they legally refuse my rent payment and file eviction on me? Please help if you can, I am freaking out over here.

    What does your lease say about late fees?

    If you want to push things to the point that you're in court, you'll be free to argue to the court, to the extent that the facts would support the argument, that the late fees aren't described in the lease and thus cannot be asserted (they are a matter of contract), that the landlord's past acceptance of rent without your ever having paid late fees and thus the provision should be deemed waived, or that the late fees are excessive. We're not in a position to assess those defenses, or any others, as we don't know the relevant facts.
