My question involves landlord-tenant law in the State of: ny
Not unless there's an applicable provision in the lease.
I've consulted an attorney on this, and his take is both LL and tenant should benefit by such an out if such a provision is included. I'm a LL, and if I have such a provision in the lease for the tenant, then I should include one for myself as well, such as if I lost my job, I can ask my tenant to leave so I can sell off my condo, the same as a tenant can ask me to void the lease if he lost his job. Would you want to to live somewhere where if a LL loses his job, you get thrown out??
More commonly, a LL moves out of town to take a job, and would want to move back when his circumstances changes, and in these cases, a LL cannot just throw the tenant out. This happened to Obama's chief of staff Rahm Emmanual. He quit his job to run for mayor of Chicago, wanted to move back to his house, which he rented out. His tenant told him to take a hike, as he got a lease, and he's not moving, even if Rahm needs the house to move back to to run for mayor. Bottom line, a lease is a lease.
