    Default Teenager Falsely Accused of Rape

    I would really appreciate some advice on any legal recourse we might have. My son is 16 years old. He has been falsely accused of rape by a 13 year old sister of one of his friends. I must say that she followed and stalked my son both before and after the "alleged incident". The lie will soon be known for what it is by the court as in her police report she states that my son held her down on a futon in her bedroom. There is no furniture at all in her bedroom as it is still under construction and there are several witnesses to this fact. She made this report 2 monthes after it allegedly happened and has no evidence to support her claim. Furthermore, her father called me on the phone to report her claim - I believe to try and extort money - before going to the police. Therefore, there is no doubt to my son's innocence.

    My question is this - once the court dismisses the charges, do we have any legal recourse against either the family or police? On the first subject let me say that she has spread this rumor rampant through our town of about 5000. Even people that my other son (20 year old) knows, have been text on their cell phones about these accusations. On the second subject of the police, I don't bellieve it is prudent or responsible police work to accuse someone of holding a girl down on the futon and raping her without even investigating to know that there is no futon! This has cost me unbelievable amounts of stress...as my husband and I are a professional couple in the medical field, along with over $2500. in criminal defense fees, pi fees, and supervised release fees and time. All for a crazed teenager how is lacking attention at home! Not fair, can you please advise? Thank You! CJ from kansas

    Since these are both juveniles different rules apply and your best source is the criminal defense attorney who can advise based on the facts and the outcome of the case as to what your options are, then you can evaluate whether the continued attention of another legal battle is worth it. The relevance of whether or not there was a futon in the room at the time is a small issue in the overall facts, a futon can be easily moved into and out of a room. The possible extortion is a different issue. Was there any medical evidence of sexual activity? sexual assault may also involve non physical acts. Who was supervising the girl at the time?
