    Default How Do You Serve Someone Who Refuses to Provide a Forwarding Address

    My question involves small claims court in the state of: Mississippi

    My roommate encountered a financial hardship in October. I sympathized with him, and allowed him a week or two to pay rent. It ended up being a month, he moved out, and did not pay for October's rent.

    He refuses to provide me with a forwarding address to serve him the papers to go to court.

    He is a 1099 employee therefore I can't serve him at work.

    How can I serve someone who does not want to be found?

    You either figure out how to find him (friends, family, people/places he hangs out, internet searches, watching his FaceBook page, etc.), or you pay someone like a private investigator to find him.

    both capacities. He was a roommate and tenant of one of my rooms.

    Your rules of civil procedure appear to say that you can sign an affidavit with the court clerk that you don't know his address, and work with the clerk to publish the notice in the local paper once a week for three weeks. I'd start with the court clerk.

    I don't know anything about your law about 1099 employees and not being able to serve at work. I did an electronic search of your rules of civil procedure for "1099," "employee," and "employed" and came up blank.
