    Default NYC Disobey Park Regulation

    Hello, I need some help regarding a ticket I got last night. Me and a couple of my friends were at a park and we were given a ticket at 11:55pm. The officer was fine with everything, and we weren't doing anything illegal, just simply talking at the park. The officers said they had to do their job, and we weren't allowed to be in the park after dusk. The entrance I entered from didn't say anything about the time the park close, but there was another entrance about 3 blocks down that says it closes at dusk. I did some research and realize we all got tickets for section 1-04 under Prohibited Use instead of section 1-03 General Provision which should be for a park after dark ticket. The "Other" section is written as PRR and the description is Disobey Park Regulations. Here are some of my questions -

    1. Is this a mistake on the officers part? They told us we were getting a ticket for park after dark, but written as section 1-04, no sub section was written.
    2. Should we contact the precinct about this issue or explain it in court?
    3. What are the penalties for this summons? If fines, usually how much?

    What is your argument that Sec. 1-04 is not applicable? You just told us that you were in an area of park property that was closed to the public, and that seems to fall within the ordinance.

    Im pretty sure park after dark falls under section 103, unless their technically the same thing. Section 104 seems more severe, as its sub sections shows its for destroying trees, harming others or animal and selling illegally.

    You're not being accused of violating every provision of the ordinance - just (presumably) the portion relating to being on an area of park property that was closed to the public.
