    Default Backing into a Vehicle While Exiting a Parking Spot While they Entered the Lot

    My question involves a traffic accident in the State of: Oregon

    I was reversing from a parking spot at a Dari Mart, facing the store. A car, directly behind me, was exiting the parking lot, while another car, that I couldn't see until we collided, was pulling into the parking lot at the same time the first car was waiting to exit. It was dark and I didn't see their headlights. I'm assuming they saw me before we collided. i am just wondering who is at fault. given the circumstances, it is hard to put blame on either one of us solely.

    Generally speaking, the person backing up is going to be held responsible for an accident. Each insurance company involved can make its own determination of fault, or how fault might be split between the parties.
