    Default What if Your Deed Still Says 'A Married Man' After Divorce

    My question involves real estate located in the State of: Florida

    I am getting divorced which should be final next month. I'm going through the process pro se and so far everything has been fairly simple. I purchased a home after we separated and my son to be ex is not on the mortgage or the deed. My concern is the deed has my name followed by ” a married man”. Would this be a problem at anytime in the future? If so, what steps do I need to take to correct this after the divorce is final? The divorce is uncontested with me keeping the house which was not purchased with marital funds or while we were together anyway.

    Was your wife on the deed? If she was there would need to be another deed conveying away your interest.
    If she wasn't, it might behoove you to get a quit claim from her showing she expressly disclaims any interest (a quit claim doesn't assert you actually have any interest. This is one of the few times it's a good idea).

    When you sell the property, if the title search/insurer shows you were married when the property was acquired, a copy of your divorce decree and property settlement would probably suffice, a quit claim would be golden.

    Her name is not on the deed, just my name as a married man. Would I put her on the quit claim our just deed it to myself as not a married man?

    You can NOT do anything. SHE would need to quit claim her interest to you.

    Just clarifying how the quit claim will need to be worded. She will be listed as the only grantor (even though her name does not appear on the current deed) and I would be the only grantee? Or should I put both of our names as grantors and just my name as the grantee?

    is she willing to agree to signing a deed to you? This is not something you can do in her name.

    if she is willing, it would be a deed with her as grantor and you as grantee.

    yes she is willing and it was put into our marital settlement agreement that i got the house. it was purchased with non-marital assets after our separation anyway. thanks for everybody's help. i will get one drafted up showing just her as the grantor and me as the grantee.
