Sounds like there is no way to get the point off is there? I'm just worried about my insurance rates going up I'd be happy with paying the fine.

Since you've now clarified you CAN pay if you had to, I recommend talking to local traffic attorneys. From what I've heard, a number of them will take on minor infractions like this for a flat fee ($100-200); in exchange they usually get it amended to a non-mover with the same fine.

Its hard to see but the height of the no right turn might be an issue.

That becomes the MUTCD-based defense I mentioned which is difficult to prepare and put up, pro per. If you somehow end up going to trial without an attorney, tjackson, you can certainly give David's suggestion a try.

Same fine so that means point still though right?

Would you explain more how I would use the fact that the sign is under 5 ft for my defense? Thank you

No! The violation gets changed to something non-moving (no points) that's designed explicitly for such deals, like VC 23333 and the judge sets it to the same fine as your original offense.
