My question involves landlord-tenant law in the State of: Tennessee
Is it legal to Make a Lease when tenant moves out when there was NO lease to begin with.
My friend rented a guest house from my father.
My father, to be referred to as the Owner, never made a lease in the beginning as it was just a good will move.
It was a verbal agreement "hey I have a guest house, you need a roof" agreement.
My friend did pay $800 a month. She has not paid October b/c she is moving to a cheaper place.
The Owner now wants her to sign a Lease he drew up and said he will sue her for 18% interest a month until she pays October.
Is this crazy? Unfortunately I think it is selfish as the Owner has fallen on hard times b/c he killed a 10 year old girl in a traffic accident in July and now seems to think he can make a Lease 'after the fact'
