Default Caught with Prescription Drug That Was Not Mine

My question involves criminal law for the state of: South Carolina
My son was caught with a prescription drug (Suboxone) that was not his. He now has to go to court. He lives in Indiana and must return back to South Carolina for a court date. Is this considered a felony? Does he need an attorney?

I expect that it is a felony and it would be a good idea for him to retain counsel.

You can look up the statute he's charged with violating here.
