My question involves a marriage in the state of: Michigan
My wife and I separated in March of 2011. At that time, I left (she had moved in her new boyfriend). I took limited personal possessions (clothes, books, dvds, my laptop, etc) and lived with friends until September 2011. At the time I left, I was devastated and told her just to keep everything (our assets are extremely limited, as I was a college student and she was unemployed at the time) as I was basically living on my friend's couch and had nowhere to store items. Now that I am able to file for divorce, I plan to do so. I would like some property back, including all of my personal property (which I understand to be all the things I owned before our marriage) and well as a portion of our limited marital assets (I don't even want 50%, just a few items). Later, we agreed that I could have part of the marital property in exchange for allowing her to keep some of my personal property. She never allowed me to come get these items, nor did she bring them to me.
I guess my question is: Am I entitled to anything? I left all of the property with her and I did tell her that she could have everything in a text message after I left, but 1. I hadn't really considered what that entailed 2. Was being replaced by my wife's new boyfriend and was not in my right mind.
In August we were on good terms and had decided not to divorce for money reasons (I am an independent student for financial aid purposes only if I am married; otherwise I am my father's dependent). At the end of August, I lent her $500 so she could pay the deposit for a new apartment. Foolishly, I did not get the agreement in writing. I understand that unless she is willing to tell the truth about the loan, I am out of luck. But assuming that she does admit it was a loan, am I even legally entitled to it's return?
