    Default Sold Vehicle With No Bill of Sale, Buyer Wants Me to Give Him Some Money Back

    My question involves vehicle registration or title in the state of:

    I sold my vehicle with 130,000 miles on it in the state of California. I gave him the pink slip.
    I tried to fill out the Release of Liability but didn't have the buyers name nor address so i called him. He began cussing at me and asking me to refund some of the money since the transmission is bad. I told him i had no idea and he says he will be taking me to small claims court.
    I did some research and i realize now that it would have been a good idea to filled out a Bill of Sales stating that it is AS-IS condition.

    Buyer test drove it and looked over the car. It seems like he is a Car Shop owner and trying to make a quick flip. I told him i'll refund him the money if he'll return the car however he said he already took it to a body shop to get painted.

    Car was a 2000 Sentra. Sold it for $1900.

    Should i be worried? I filled out the Release of Liability with just his first name and everything else was listed as unknown.
    He also said he'll be coming to look for me. He has my address which is on the pink slip.

    He may have you if you did not provide a smog certificate.

    He's irate that you supposedly didn't tell him about transmission problems before selling him the car, despite his test driving the vehicle and finding no problems, but took it to a shop to be painted despite there supposedly being problems with the transmission? I agree with you, that something doesn't sound quite right. Did you come up with any evidence that suggests he's flipping used cars, or is that supposition?

    If it turns out that he is in the auto trade, he has even less excuse for not identifying the problem before buying the car.

    As it stands, although it would have been a good idea to have an "as is" bill of sale, you didn't make any express warranties, and there is not ordinarily any implied warranty in a private used car sale. I expect that he would have an uphill battle in court.
