My question involves a traffic ticket from the state of: Ohio
Last week, my boys and I were traveling on I-675 and was merging onto I-75. It was raining hard, cloudy, and kind of foggy in areas so I was only doing between 55 and 60 in a 65mph zone. When merging, a semi came beside me, started sucking me over, toward him, in his draft. I very carefully tried to get out of his draft, by very slowly moving to the right, away from him. His draft sucked the back end of my car around, and causing me to start spinning. We spun 4-5 times, I was able to keep the car in my lane and while spinning, went toward the shoulder, then we went down the embankment and came to a stop. I didn't hit any other cars, no road signs, I didn't hit anything except a few trees that helped me stop. The only thing damaged was my car. The Ohio State Trooper never asked what happened, he just handed me a clipboard and said right your story. He then told me to right my sons names, birthdates, and where they were sitting at the time of the accident. He then cited me for failure to maintain. The wrecker guy that came and pulled me up (among others), said he surely didn't cite you did he? He said that he had been to other accidents like mine, and as long as there was no damage to anything, the drivers were not cited. So this got me thinking, Is this a true case of failure to maintain? Or just an officer having a really bad day...it did take him 45minutes to get to us when the 911 operator said he was right there near us.
What is right?
