    Default Appellate Tax Board Refuses to Allow Recordings

    My question involves civil rights in the State of: Massachusetts

    Is the Appellate Tax Board considered part of the Massachusetts legal court system, bound by the rules and laws of all Massachusetts courts? If so, is an Appellate Tax Board hearing considered a public hearing where all proceedings may be recorded? I ask this question because at two previous hearings before The Appellate Tax Board, recordings were forbidden. Anyone may attend so it is apparently a public hearing.

    What Massachusetts rule are you looking at that permits spectators to record court proceedings? In most states, if the court says "no recording" you don't get to record.

    I was under the impression that anyone could record a public hearing. Since the Appellate Tax Board (ATB) isn't a true court but a "quasi-judicial" authority that may hear cases and issue rulings. I believe that a hearing before a single member of the Appellate Tax Board would be considered a public hearing. Since the ATB does not record the proceedings as a matter of course, I believe that the appellant should be allowed to record the proceedings if the "court" does not record the hearing. Why would the hearing officer have any issue with an appellant making a recording of his/her own hearing?
