    Default How to Sue for Wrongful Accusation and Detention for Shoplifting

    My question involves criminal law for the state of: State of Ohio

    Can someone tell me (besides small claim court which I do not want) what other courts exist to sue a compnay for around $ 500,000.00?

    I was being falsely accused by a store, and cop came used foul language talking to me in the store. Store still got some of items which I paid for showed on my receipt. I took those items off my carts and they said they were not showing on the receipt and when I got home some of them they said were not paid for were indeed showed on my receipt. Besides, store cash registers didn't work well caused all that drama, which I had nothing to do with.

    I got falsely accused because I was argued too much for receipt. Cop came without even listen to me and started to patch me down, check me out for guns and headed to back room and charged me with theft.

    Note: This post is not to discuss the false accusation, but to know how to take the retail store to court and charge them with stealing me and falsely accuse me; cop came in the store used foul and threatening of doing this and that to me to scare me. That's what my case will be about.

    But I will need help on how to take this to a bigger court then small claim court. I will need to know what " Form" I need to ask when I get into the court, or what " Title chapter and code" to base my case on, etc...


    I have using others legal forums and I do not need any discouraged, lazy comments reply. Laws must be laws and apply equally to all! Human Rights Firsts!


    CAUGHT ON AUDIO AND VIDEO RECORDED AND PLUS STORE CAMERA VIDEOS- THEN I HAVE NO CASE HERE??

    UNLESS THIS COUNTRY IS DICTATORSHIPS RULERS LIKE MANY OTHER COUNTRIES, I DON'T SEE WHY I HAVE NO CASE!

    You are also welcome to consult a local civil attorney to see if they would be willing to help you out, either for a cut of the payout or you paying them. That will be a good indicator of the vaule/odds of winning such a case.

    Depending on the full facts of your case, and whether Ohio has any kind of merchant protection statute, you may have no case against the merchant. We cannot properly advise you based on the limited, and poorly written, facts you have presented. Based on dogmatique's response to your other diatribe, I'm guessing the answer is probably no.

    The damage?: Cop came in and put hands on me, searched me; cop threatened to knock me down; Cop threatened to have other cops come in and enjoy the party with him without me saying of doing anything;

    So, the real thief was the store employees and the police who probably getting bribe from the store employees. According to video and audio recorded, it is clear and I am confident if I can only bring my case to court, I would definitely WIN!

    Otherwise, unless this country is purely dictatorship and full of Human Rights abuses, I don't see how, I, a customer used some defective cash registers in a store and have to be the one charged with theft because I complained and kept asked for a receipt?

    What's wrong with this thing when I post reply for different people all the posts go into the same person?

    I don't think you understand how the court system works in this country.

    Please hire an attorney.

    A message board cannot help you.

    The posts don't all go to the same person, but when everyone is giving you the same answer, it might seem that way.

    You have a very poor grasp of the judicial and criminal justice systems. As such, you are incredibly UNqualified to bring a case anywhere OTHER than small claims court. That's not meant to be a slam on you, only to inform you that if you stand in front of a judge in a common pleas court and attempt to rant what you've posted here, you'll get about 2 sentences in before the case will be dismissed.

    If you're adamant about getting an expensive education on the realities of the systems, you'll need to sit down with an attorney and let them explain the same things to you, at a couple hundred an hour. Contact a few local ones, many will give at least an initial consultation for free. While you're waiting on them to call you back, Google the terms relevent to your case where you're falling short, starting with basics like "intentional torts", "damages", "intentional infliction", "reasonable man test".

    I will add to the above and say that a free internet board populated by volunteers is not the correct place to build your case. We will guide you and even post relevant law from time to time, but to ask us to do all the legal research and then help you prepare your case is outside what this board is capable or willing to do.

    To insure that the correct legal proceedures are followed and the correct law is quoted, your best bet is an attorney that can review your entire case and guide you to success.

    I guess that puts me in the "lazy" category. If you are going to be upset every time a free message board doesn't give you hours of free legal advice, you are going to be upset a lot.

    So in the other forums, people did "discouraged, lazy" things such as telling you what the law is, and what you want us to do is to give you a fairy tale about how easy it will be for you to get $500,000?

    You say that you were criminally charged for shoplifting from the store. How was the criminal charge resolved - an unconditional dismissal, diversion, deferral, plea bargain (to what), conviction... ?

    This chart explains the Ohio courts. If you want to claim damages above the small claims limit, the next court is the Court of Common Pleas.
