My question involves civil rights in the State of: Delaware (employer was in PA)
I recently was wrongfully arrested and charge with felony gun charges. Officers arrived on scene where I was shooting an airsoft bb gun inside the state park limits, an offence that usually warrants a park fine, similar to a parking ticket violation.
The officers had me restrained in handcuffs due to the fact that the person who called me in to the police stated I was shooting a high powered rifle. The officers looked over my bb gun that was located near a park bench, it became obvious that the item was an airsoft replica shooting 6mm BB pellets similar to paintball. (I did not have anything on my person as they arrived besides my car keys and cell phone)
The officer used my keys to open my car without my permission after taking them from me during a pat down. The officer used my remote unlock button to find my care and proceeded to unlock my glovebox. After finding firearms 100 yards away inside of my vehicle, they charged me with illegally concealing a firearm on or about my person.The charges were dropped after a pre-trial hearing that hinted toward wrongful charges and the rest were pleaded down to a 50$ park violation.
During this time in which I was wrongfully arrested for a felony, I lost a year contract with Bank of America after a background check produced this felony arrest. The background check company was Lexus Nexus. Since then I have cleared my record with Lexus Nexus and have been sent a copy of the clean report.
Due to the police wrongfully illegally searching my vehicle without my permission, I have extensive monetary loss due to not starting my year contract with Bank of America.
Do I have a case vs the state or employer?
