    Default How to Terminate Biological Mother's Rights

    My question involves guardianship in the State of: Florida

    My husband and I have been raising our eldest boy for over 4 years now but I married my husband and he had 4 boys from previous relationship. 3 of which are his biological sons and the eldest boy is from the same mother but had left him with my husband which my husband has been the eldest's guardian since he was 2 yrs old he is now 11. She left the eldest with now food no clothes just the clothes on his back forcing my husband to buy everything for him without any financial support for any of her sons. She has no interest in being in her sons' lives and over 4 years ago my husband had requested for her to sign over her rights for the eldest at least to gain full custody of him and the biological father is unknown and even unknown to be on the birth certificate. My husband and I are unable to retrieve a birth certificate or social security card due to not being any of the biological parents. I just have a SSN on a piece of paper for the eldest.How do my husband and I terminate the biological mothers rights without her cooperation, an address to reach her, or a phone number to reach her? My son's school also mentioned when we tried to tell them that she abandoned the boys and are no longer in their lives that if she wanted to pick them up at school she was able to because she is their biological parent and that we had to have proof that she doesnt have any rights to them anymore what should we do?

    The school is correct - Mom hasn't legally abandoned them. In fact, she is the only person who can, at the moment, legally do anything!

    Your husband needs to speak with an attorney immediately. He has two options, really - file to establish de facto parent standing (which would go a long way), or try for third party custody (tricky in most States - much trickier in Florida).
