    Default Roommate is Selling Drugs

    Hi,

I am hoping to get an idea on what kind of penalties I may face for a roommate selling narcotics from my home. She keeps a substantial amount of meth and coke in the house, and everyone knows she' s under investigation. I' m scared to death. I' ve never been involved as a dealer, only user. Though I' m sure they will try to hit me as hard as they can, but how can I be responsible for a roommates business?
Also, what if she were to claim everything a take full responsiblity for everything?

    Thanks.

    Have you been arrested?

Since you know what is going on you risk being charged with possession of whatever she has, participation in her trafficking, and maintaing a drug house, possibly along with other offenses.

Thanks for your response. I have not yet been arrested for the situation I' m talking about. If everything is in her rented room, how can they prove that I have any knowledge of it?
Again, if she were to claim everything as her own like she should, would that help me?
I' ll take a possession charge, but the intent charge is what I fear. Especially since I have no intent.

Intent can be inferred from quantity alone. If you know it's there, and they probably have or will try to have informants make buys during which you may be (or may have been) present, there is a substantial chance that you'll be charged as an accomplice, accessory, or partner in crime.

Your choice right now seems to be between having a drug-dealing roommate because you like having ready access to the drugs, or minimizing your chance of being charged with serious criminal offenses.

    Yes, I agree.

Q: If everything is in her rented room, how can they prove that I have any knowledge of it?

A: That would be the easiest part of the case. You are in the house itself and you know about the dope.
