    Default Visa Canceled First Under 214b

    Hi,

    I got a letter ON APRIL 2009 from US embassy in my country saying my Visa was removed under 214 (b) and the letter said , come when your status has changed PLEASE apply again for new visa.
    This happened on 2009 when i was arrested supposed with 5 kilos of coca in my house, 5 months later i was found innocent , after the statements of the police officers that came inside my house it got clear enough when they said they were running after some drug traffickers that run inside my house, in the pursuit this people trowed drugs in my house back yard ,when they were trying to climb my neighbor wall. I was the one arrested in this confusion (in hat time i was nephew of the Attorney General of El Salvador) after this he wasn't reelected ,it took me 5 months to clear this false accusation , then when i got all the documents saying i was Innocent (not guilty) i when to the consulate and reapply to my nonimmigrant visa, they took my passport for 3 months with all the original documents , until yesterday, i received e mail from them saying come tomorrow for second interview at 9 AM , so i when with all my bank documents and credit cards to prove my family ties and the supposed interview only lasted 10 seconds, they gave back my pass port and a letter saying my i was inadmissible under 212 (a)(2)(C).
    Is this normal? Legal ? Or correct , coming from a country always always brag about obeying the laws and human wrights ?

    How are they to know for sure your nephew didn't get the entire thing covered up. Yes, it normal to try and keep people who might be undesirable and engage in criminal activities out of the country. Our constitution does not guarantee anything to foreigners, sorry.

    The former drug case is the likely cause of your current denial. I suggest that you consult a US immigration attorney to review the documents regarding this case to determine if you have the proper documentation to present a good case for your US visa. Your sense of urgency and entitlement that is evident in your posting is certainly suspicious and, if evident to the officer interviewing you, prejudice your case against you. Your family connections also work against you.

    Remember, the US can determine who it wishes to allow into the country and the reasons for a denial may seem unfair to the applicant. No foreign national has the "right" to receive a visa. They were certainly legally able to deny you a visa. All you can do is reapply.

In the taped conversation, Tórrez states that for $500,000, he can clear Silva of all charges, and that judges and prosecutors have already been contacted and brought on board. Compounding the scandal is the fact that the national prosecutor, Attorney General Félix Garrid Safie, also an ARENA party member, had access to the taped conversation but dismissed charges against Tórrez.
    You can infer why U.S. immigration authorities may be skeptical of the manner in which people are cleared of drug charges in your country.

    This is what i am trying to explain,i think Us authorities think my uncle might help on my case, but due to my arrest and that other case of Roberto Silva Garrid Safie never was reelected , instead the opposition took his place and removed all his loyal friends and other judges that might be moved of influenced to ARENA or similar, i was judged the hard way !!! Had all the oposition against me and even having a entrie politicla party that is still on command of this country i was found innocent , not even 1 police oficer declares that y was even close that drugs not even on reach of my eyes.
