    Default Sex Offender Has Keys to Our Home

    My question involves landlord-tenant law in the State of: Wisconsin
    We recently found out the property owner has given the management position to a sex offender she is renting to. This means he has keys an access to all of our homes. She also is aware of the fact that he is a sex offender becise it has been brought to her attention in the past. We no longer feel safe due to A W degree sex offender having keys and access to our lives. You would think it would be common sense NOT to give a sex offender access to everyone but since it obviously isnt can we break our lease?

    Nope. Unless your lease has a clause that allows you to break your contract because you don't approve of your property manager, you are obligated to fulfill the terms of your lease agreement. That your new property manager is a sex offender (please explain W degree?) is irrelevant.

    Well the police here say it is illegal to knowingly hand over keys of peoples homes to a sex offender so its hard to believe there isn't something we can do about it.. (second degree)

    Ask the police to cite the law that they are referring to. I know of no law that forbids a sex offender from being a property manager as long as they are operating within the guidelines set up for the position (ie, entering upon proper notice, etc).

    No, it's not illegal for a sex offender to be a property manager. You can certainly move out if you choose, but when your landlord takes you to court for the breach of contract, you WILL lose. "The property manager is a sex offender" is not sufficient cause to break your contract.

    If police had reason to believe it was a CRIME, they'd have treated it as such and made an arrest. Since they didn't, that tells us that their intended message wasn't that allowing a RSO to have keys was "illegal" per se, but could be a situation that could create civil liability. However, such civil liability doesn't "trigger" until and unless there are ACTUAL damages - just as a landlord not keeping the sidewalks properly cleared of ice or debris. Until someone ACTUALLY slips on that ice, there's no suit. Similarly, merely being a RSO doesn't in and of itself CAUSE anyone damage, even IF it MIGHT heighten liability for an employer and result in extensive punative damages after/if some tort occurs.
