    Default Medical Provider Refused My Payment

    My question involves collection proceedings in the State of: Virginia. I attempted to make a payment on the account. The creditor refused to accept the payment, sent it back to me along with a letter, because it was not the minimum/total amount due. Where do I stand at this point? I have heard from numerous people that if a creditor does that you no longer owe anything on the account. If you can provide a link to any legal statute it would be appreciated. Thanks!

    You heard wrong. A creditor does not have to accept anything less than what is due. It does not affect the validity of the debt in the least. Some creditors will refuse partial payments to avoid having a debtor attempt to argue they agreed to payment arrangements and use the partial payment as evidence. To avoid that, some creditors make it an all or nothing situation.

    Why did the creditor return partial payment rather than simply crediting the payment to your account and billing you for the remaining balance? For example, did you try to make the partial payment as "payment in full"?

    No, I did not try to make the payment as payment in full. Simply wanted to make a good faith effort toward reducing the balance on the account which is less than 400 dollars.

    I have a similar situation; although key differences exist:

    1) Date of service: 11/5/2010
    2) First bill from medical provider: 5/10/2011
    3) Turned over to collections: 6/2011.
    4) Dispute arose as my current plan indicates 100% coverage of Emergency Medical services. Further investigation (since 6/2011) finds that the 100% coverage is permitted only for emergency responders. Emergency room co-pay continues to apply for hospitals outside of plan.
    5) Total bill $962.86
    6) Payment for entire billed amount issued 9/16/2011.
    7) Notice and rejection of check (#5173; Amt. $962.86) received 9/30/2011. Reason given, account turned over to collections.

    What is of a major concern:
    1) I have an excellent (Category: B) credit raiting.
    2) Collection firm has submitted the information to credit scoring organizations.

    Please advise on the following:
    1) Within Texas law, is the medical provider able to reject the payment for the grounds stated?
    2) Under what provisions is the creditor able to reject a payment for entire billed amount within Texas?
    3) Is there any recourse for fraudalent billing practices and/or inappropriate reporting of credit issues?

    Thank you for any help you can provide.

    but as a quickie:

    Turned over to collections or sold to a debt buyer. If they sold the debt to a debt buyer, they would be correct in refusing the payment as they no longer owned the debt. If it was only in collections, then they should have accepted the payment and refusing to accept it could likely be used as a defense to not paying the debt. Even if a debt is in collections, (as opposed to being sold to a debt buyer) the creditor is still the person that is owed money and the collection agency is simply hired to attempt to collect the debt.
