My question involves name change laws in the State of: Texas
My child is 13 years old at the time of birth I my current boyfriend signed the birth certificate and gave my child their last name. Later on we had to go to court for child support in which a paternity test was requested. The test came back negative. My current husband is the other party he has signed the Acknowledgement of paternity form and declines a paternity test. He advised the Attorne general that he was sure he was the father. I have sent the forms from the first paternity, the acknowledgment of paternity and still no name change. I recieved a letter back stating that a court order paternity test with the seal from the county clerk office. However my husband is delcining the paternity test and states that he is not wanting to take it cause he believes the child is his. What is the next step? Do we have to take the test if he is declining the test? Can we go to the county clerk to get the signed document stating that he is deniing the test to have the name change? Or what is the steps we will have to take to get the child name changed.
