    Default Getting Probation Terminated Early to Move for a Job

    My question involves criminal law for the state of: Florida

    My husband and I pled guilty to 3 misdemeanor charges for failure to remit sales tax. The judge order 3 years probation and restitution of $13,750. We paid 1/2 the restitution ($6,875). We have only completed 6 months probation. A family member is willing to give us the money to pay off the remainder of the restitution ($6,875). Can we request Early Termination if we pay off the restitution balance? If so, how likely is it that it will be granted?

    My husband has received a job offer overseas and we are hoping to get out of probation so that he can accept this new job. OR can we complete our probation from another country?

    You can request whatever you want to request.

    If you pay off restitution and explain the issues of the move, perhaps you'll sway the probation officer to recommend discharge. You can ask about permission to travel and to report by phone or mail. Nobody here can give you odds or make promises - talk to the lawyer who represented you for the underlying charges.

    Who do we make requests to? Our probation officer or the courts?

    During probation is travel abroad permitted legally?

    You will need to check the terms of your probation to find out whether you are under travel restrictions. It's not at all unusual for people on probation to have to inform their probation officers of out-of-state travel, and to get permission for international travel, but we have no access to your case file so we have no way of telling you what restrictions may exist in your case.

    It would not be sensible to bring a motion for early termination of probation without first talking to your probation officer.

    Even if you are not allowed to terminate early from probation, if you talk to your PO, you may be able to interstate compact you probation to the other state.
