    Default Can a U.S. Collection Agency Garnish a Canadian Bank Account

    My question involves collection proceedings in the State of: Arkansas

    I have a federal student loan that I cannot afford to pay. Can DCS collect in Canada for a defaulted student loan taken out in the US?
    Please advise.

    The creditor would have to work through a collection agency that is licensed in Canada and, to the extent that they wish to employ judicial remedies, would need to get their orders through a court in Canada. They cannot enforce a U.S. judgment in Canada unless they domesticate the judgment. Note that many banks are now international in their operations, so depending upon the bank and circumstances they may be able to garnish a "Canadian" account through a U.S. office of the same banking institution.

    As a US resident working in Canada, you are required to file and pay US taxes. They can take your refunds.

    Can you tell me how the collection agency would be able to find my bank account in Canada? I opened the account using my ID only, no SSN#.

    Nobody here can tell you whether or how a particular collection agency will find a particular asset.

    Because the posters here aren't collection agencies. Every agency is different. They can utilize many different avenues.
