My question involves criminal law for the state of: Ohio
Hello, I was wondering whether or not I could fight an underage possession charge. I am 19, and I was pulled over for speeding. The policeman noticed an open case of beer in my back seat, which resulted in him searching my entire car. He found 7 cans of bud light and 2 cans coors light, none were open.
Here is my story.
Truth is, it really wasn't mine. I know everyone probably says that, but in all honesty is wasn't. I was driving to my grandfather's house after leaving my grandmother's house (they're divorced:it's complicated). Any way, my brother had used my car over the weekend to visit some of his friends near my grandmother's. Late Sunday evening we were meeting up at my grandfather's for dinner. I was pulled over en route.
I can honestly say I did know that the beer was in the back seat, however, did not know it was illegal to have when unopened. I have been charged with an underage possession misdemeanor and have already met with the prosecutor. I have plead not guilty both times being to court already and I am summoned today for bench trial. I do not have a lawyer, and I was wondering if I should revoke my plea or stand as is (not guilty).
Any help would be appreciated.
