    Default Sharing a Bottomless Cup

    I heard of some people buying a cup for a place that gives botomless refills from a soda machine. As smart as the people are they recycle their cup so they can come back and get more soda the next day. These people buy lots of items from this bakery. The other twist is people who order sandwiches ask for a small water cup and fill it with soda how come the store does not tell them not to but says this activity is not legal.

    Also someone pulled out a cup from a dumpster and cleaned it and it was from the store with the logo and everything and used it. Is that legal or illegal since it was from an off sight dumpster? I think it's gross but if they are saving money.

    The reason I ask is because this person was told that if he was caught getting cups from another source the police would be called and he would be banned from the building . He was told not to bother customers etc.

    Quesitions are:

    1. How can the store have proof that he took the cup from a dumpster if a friend bought him a cup.

    2. If he pays with cash how can the store know the person if he returned an item since there is no proof.

    3. How can the store know if the cup was taken from another source and cleaned out? With so many people coming in and out it's hard to tell it's not like your taking a cup from anoteher store.

    4. Also coffee cups are laid around the table and this person cleaned out the cup and used it. How can you proove it was another person's cup?

    This is a scenario that I have heard from a friend and I wanted to know how a store can call the police ban the person if they recycle the cup and uset on a future visit? Recycle=good ethics not illegal. Any opinions on how to understand the scenario. My friend is not sure how to understand this either and suggested that I post it in a law form.

    I'm sure the store's policy addresses these issues. It is obvious, if a person asks for a cup for water and then takes soda, that they are stealing.

    Again, I'm sure the policy of the store is that the customer that purchased the cup is allowed to get free refills. I also agree, that is gross!

    Above you stated that if they caught him getting cups from another source they would take action against him for this. I'm sure if it were purchased by a friend legitimately, it shouldn't be a problem.

    How hard do you think it would be for the employees to state whether or not he was a customer?

    Do you know if they have security cameras?

    I would think that they are catching on to someone who is taking advantage of them.

    At any rate, if you make a legit purchase, it would be wise to keep the receipt.

    Whether they can prove it or not, is only an issue if they decide to press criminal charges. If they suspect someone has bee ripping them off, you could expect them to ban that person from their store.

    Again, that is gross. I don't know how they can prove it, but I suspect that they are on to somebody. Perhaps security cameras, employee testimony.....

    Recycle the cups all you want, just don't go get free refills when you or your friend didn't purchase that right to do so.

    Tell your 'friend' to stop being such a cheap ass and pay for 1 and only 1 clean cup. It's a safe bet he's not dating, "Buy you a soda babe....hold the lid open for me will ya....HEY pizza, want some?"
