    Default Letter from Collections Attorney for Warrant Notification

    My question involves collection proceedings in the State of: Texas

    I haven't lived in Texas for over 11 years. I recieved a Letter from a collections attorney for warrant notification that states Their firm was hired to collect on a outstanding case pending against me for failure to appear in court to answer charges made against me 10 years ago. After calling them and the court I found that 3 checks had been written for $45, $67, $89 to a grocery store in the area of my home town. I haven't lived there for 11 years this past May. They are telling me that I owe $1800 dollars to take care of this matter or a arrest warrant will be issued for me.
    I didn't write the checks and the account was closed a year before someone somehow wrote those checks...I tryed to contact the store, but they have been closed for over 6 years now and the lady at the Bank told me their records do not go back that far. I live 1600 miles from that area and can't afford the time or money to travel there to fight these charges. What can I do ???

    If you have warrants outstanding for your arrest, you can appear and defend, or you (or a lawyer on your behalf) can contact the prosecutor to try to negotiate a resolution that does not require you to appear in court.

    It is not clear from your post who is responsible for the letter or on what authority. It would be unusual for a unit of government to send a letter, in effect, that "You blew off court for your criminal case, but if you pay a huge fine we'll dismiss the charge." Fill us in on the details.

    The Letter came from Linebarger Goggan Blair & Sampson out of San Antonio TX. I moved from Texas in May 2000. After I read the letter I called them and inquired as what in the world they were talking about. They told me that in March 2001 someone had written 3 checks that were turned into Harris Co courts for Issuance of bad check. I never received any notice of any of this. I just received a letter from the group via regular mail last week. The letter states---Our law firm has been hired to represent Harris Co. in the collection and disposition of the above listed matter. Court records indicate there is an outstanding case(s) pending against you for failure to appear in court to answer charges made against you.As I stated in the other post I call the court and gave them the info and they told me it had been turned over to the collection law firm and gave me the banks name the checks were written from and the Grocery store they were written to. I didn't write those checks and had been moved away from Texas for over a year when the checks were written. I never ever received any letters or anything of this court appearance until now 11 years later. The letter wants me to plea no contest by paying the fine of $1800 which constitutes a finding of guilt and waiving a jury trail. I did Not write those checks. I am 1600 miles away from Texas, and have been here since the day I moved from Texas in May of 2000. I have never received a forwarded letter or anything on this until now.

    So we're back to this: If you have warrants outstanding for your arrest, you can appear and defend, or you (or a lawyer on your behalf) can contact the prosecutor to try to negotiate a resolution that does not require you to appear in court.

    A "no contest" plea would be treated by a court in the same manner as a guilty plea.

    Thank you for your reply...I just talked to a lady at the court house about this and she has informed me that there hasn't been a warrant for my arrest issued at this time but that there may be at a later date. I will talk to an attourney in my area to advise me.
