    Default Early Release

    My question involves criminal law for the state of: Michigan

    Hi, I was arrested December 8, 2010 for possession of marijuana and paraphernalia. I exchanged a guilty plea for MCL 333.7411 after the prosecutor agreed to drop the paraphernalia charge. I was sentenced to one year of probation, February 2011 - February 2012. I have been sober (completely) since December 8. I completed my community service hours and drug counseling classes in May. Obviously I have had all negatives on every drug test I have been given. My P.O. and I have a good relationship; he has let me leave the state twice and even the country once to go on a cruise with my family.

    My question is: Would it be reasonable for me to ask my P.O. to file for an early release? Might it jeopardize our relationship/make him more strict*?
    I only have five months left, but I would like to just move on with my life.

    *EDIT I go to college about 3 hours away from the courthouse my P.O. works at. By "more strict" I mean "require more visits", as it is currently a long ordeal to drive to the courthouse and back.

    I would approach it a bit differently, by asking whether due to distance and your full compliance you might be allowed to report by phone or mail. Is your drug testing done locally or at the probation department? If the latter, I suggest either having a reliable local place where the probation officer can feel comfortable ordering you to do a test, results forwarded to him, or indicating that if the P.O. wants a drug test during the remaining time you'll be in your car and on the way down.

    The key, to me, is not asking for too much (but asking for enough).

    Are you going to college "in state?" Rather than asking to be released from probation, you should explain your student issues and see if as Mr. K. says you can get some relaxation in having to truck back down to the home town PO (phone call-ins, alternative testing). In state, you may just be able to switch offices for the testing.

    Thank you for the suggestions. Yes I am enrolled in-state. It honestly is not a huge deal, I was just wondering how feasible it would be.
