My question involves criminal law for the state of: New York
A friend has a cell phone and home phone. He/she did not hear the house or cell phone at 6:30am. He/she noticed the parole officer called and returned the parole officers phone call. The parole officer stated that he/she called both phones and did not get a response. The parole officer asked him/her where he/she was. He/she stated he/she was sleeping and did not here neither of the phones. The Parole officer stated that he/she was not home and that he/she violated parole, therefore was being written up for not being home at the time of the parole officers call. The parolee was home but did not answer the parole officers phone call but did return the phone call. Is the Parole officer aloud to write up the parolee and why?
