    Default Insurance, and Filing I130 and I485

    Hi,

    I overstayed my J1 visa since 2005. I got married to an American Citizen in June this year and we had a beautiful baby in July. (we've been together since January 2005) We will be able to change my status in the next couple of months since our finances look a little better.

    My problem:

    I got insurance before we got married and since I got married my legal status haven't changed. Right?

    I still use my ID Card from my home country here in the states since I am not able at the moment to obtain a license or ID card. (should have done it before but didn't) I was told to renew my insurance before it expires. Do I use my maiden name or my husbands last name?

    If I use my husbands then I cant show a picture ID with his last name on it only my maiden name and it will be pretty tricky at the hospital (I have cancer) when I have to pick up Meds

    Also when I file for my I130 and I485, do I do it at the local field office or do I send it somewhere else?
    Do I need any other forms and would it be possible to go visit family in my home country soon after getting a Green card?


    If anyone have any advise I would really appreciate it.

    IF you are subject to the 2 year home residency, you will be unable to change status until you serve your time or obtain a waiver. See an immigration attorney or a community service organization that assists immigrants if you are unsure of the requirements of your J-1.
