    Default Can an Alarm Company Enforce a Contract Signed by Named Lessee's Spouse

    My question involves a consumer law issue in the State of: New York

    Hi. I have been trying to cancel my alarm contract for years. They say i am in a 6 year contract. They have faxed me a copy and I notice on the contract MY NAME is listed as the lessee. But under the signature, my wife has signed her own name. Her name is not listed as the lessee. My signature is nowhere on it even though i am listed as lessee and she is not. She did not sign my name. Is this a valid contract? What can i do to prevent them from sending me to collections?

    You would need to tell us what happened - how you came to enter into the contract, how your wife's signature ended up on the contract and not yours, how long ago this occurred, how long you continued and paid on the contract before deciding you wanted out, etc. Odds are they can hold you to it - recall, even oral contracts can be enforced if their terms can be proved - but the devil is in the details.

    They must have gotten my wife to sign the contract when i was not home. But she had no idea what she was doing. Within about a year we tried to cancel and they told us we were in a multi-year contract. I explained that their salesperson said nothing about the term of the contract. The length of the contract is not even on the same page of what i signed and it was never discussed. The contract is dated 2007 and says its a 6 year contract. I have been paying it since then but every year or so i go through this with them and this is the first i think i have seen of the contract.
