    Default Inmate Not Getting Credit for Days Served As Promised by Judge

    My question involves criminal law for the state of: Texas

    At his hearing in Harris County Criminal Court 5 on August 31, my grandson had served 19 total days in Harris County jail. The Judge sentenced him to 50 days and gave him credit for the 19 days served which means he would serve 31 days and would be getting out on Sep 29 or Oct 1. The Harris County records show him getting out on Oct 8. This appears that he was not given credit for 8 days he had alread served. He says the Judge clearly told him she was giving him credit for 19 days served.

    I contacted his court appointed attorney about this and he said my grandson got all the credits that were due him.

    I have the specific dates my grandson was in Harris County jail and they are in fact shorting him by 8 days.

    Can I do anything? Can I go to the 5th Criminal Court Coordinator with written listing of the days and ask that the court transcripts be reviewed? I don't think the court appointed attorney wants to spend any time on this matter.

    Most states make day for day an option left to the jail. The judge can recommend it, but not enforce it. Inmate behavior can influence it as well.
