My question involves landlord-tenant law in the State of: New York (Brooklyn)
Hi there,
I am in desperate need of some guidance/advice in how to break my lease with my current landlord. I have had a leak in my roof for about 2 months now, and it has yet to be fixed. Due to it's location, in my room, right above my bed, I have spent many rainy nights cuddling a bucket or sleeping on the floor. I have had multiple back and forth conversations with the building owner and Super, and despite them saying, "It's been taken care of," I came home today to a wet bed (thank you weekend rainfest). I have already reported the building to HPD, twice, but I have yet to hear back from anyone on when this problem will be fixed. I've been going through my lease, but with the legal jargon, I am needing some help in deciphering my rights as a tenant. Am I within my legal right to break my lease? What kind of steps do I need to take to break it other than repeatedly calling HPD? Would I be able to get my deposit back or would I have to forfeit that? I live with two other girls, one of which is on the lease, so would she be able to break hers or would this case just apply to me? As much as I would not like to move again, I feel like I have been left with no other choice. Any assistance would be greatly appreciated!!
