    Default Possible Statutory Rape

    My sister is now 27 and she had sex with a man at the age of 16. This man was 39 at the time. They were married when she was seventeen and divorced when she was 24. Can any charges be brought against him? We live in Texas. I am asking because he has taken a job as a high school teacher and I don't want anything to happen to someone elses child. I've tried telling her she can but she thinks it is to late.

    The age of consent for sex in TX is 17, and she would have had to have her parents sign to get married at 17, so while ther might be some charge of sexual assault for being under age to consent, her parents basically approved of it by signing for her to be married, if she had a cerimonial marriage. Not it is possible that the statute of limitations may have run for her cause of action and I suspect this was already discussed with her divorce attorney.

    There are other possibilities, was she his student when they became sexually involved? There may also be opportunity to report the possibility of risk to children anonymously to CPS.

    The thing is he was a family friend. My dad asked him to talk to her because she was having problems with our mom. He file for emancipation on her behalf and she went along with it. He told her that it was better and that she had no choice but to do it his way if she wanted out of her parents house. My parents did not approve if this. Also when they went to court he told the judge that she wanted to be emancipated so they could get married. The judge then told them to get married. She acutually believed that she had to marriy him. I believe he tricked her. We were abused by our mother and he knew it. I think he took advantage of her and the situation.
