    Default Reducing Work to Care for Children - Earning Capacity vs. Caring for Kids

    My question involves child support in the State of: California

    My wife (Children's step-mom) is going back to work full time and can no longer care for my children for the 2 weekdays per week we have them (50/50 custody with bio-mom).

    We cannot afford to put them in daycare. I'm considering cutting back two work days per week to care for them in home since that makes more sense financially.

    My question is, will I still be held to my full-time salary for Child Support purposes as "earning capacity" if I am voluntarily cutting back work to care for the children?

    Yes. You can, and likely will, be held to what you're capable of earning. This would be considered a voluntary reduction in income.
